If you look at what he has presented it has a date stamp on the back of 2007. Now you can't tell me that that is the best and only proof he has.

No, he hasn't. And that's because under Hawaii state law, he is not entitled to his original U.S. birth certificate.



If you think that's not right, then by all means, write the Hawaii state legislature and ask to have the law changed. But if you're not a Hawaii state resident, don't expect them to take you very seriously.

To Tired: This is why the governor states she sealed the records and it cites the fact that THE PERSON BORN HAS the right to access and have a COPY of the ORIGINAL birth certificate. So all Obam has to do is request a copy and submit it to the press and squelch all rumors that he is not eligible to be president. Simple and transparent. Update Nov. 1: The Associated Press quoted Chiyome Fukino as saying that both she and the registrar of vital statistics, Alvin Onaka, have personally verified that the health department holds Obama's original birth certificate.



Fukino also was quoted by several other news organizations. The Honolulu Advertiser quoted Fukino as saying the agency had been bombarded by requests, and that the registrar of statistics had even been called in at home in the middle of the night.



Honolulu Advertiser, Nov. 1 2008: "This has gotten ridiculous," state health director Dr. Chiyome Fukino said yesterday. "There are plenty of other, important things to focus on, like the economy, taxes, energy." . . . Will this be enough to quiet the doubters? "I hope so," Fukino said. "We need to get some work done."



Fukino said she has “personally seen and verified that the Hawaii State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures."

Berg was successfully sued for legal malpractice by former clients on whose behalf Berg had neglected to file a response to a complaint in an ERISA lawsuit, resulting in a default judgment being entered against the former clients. Berg responded by bringing into the malpractice suit the plaintiffs in the ERISA action on a claim of fraud upon the court. The ERISA plaintiffs moved for summary judgment—which was granted after Berg failed to respond to the motion—and then moved for sanctions against Berg. Berg again failed to file a response.



On June 2, 2005, U.S. District Judge J. Curtis Joyner granted the motion for sanctions, finding that the fraud claim was "was inadequately pled, not grounded in fact, time-barred, and utterly irrelevant to the pending malpractice action against him." Observing that an attorney's signature on a complaint constitutes, among other things, a certification that the signer has conducted a reasonable inquiry into the grounds for the claim asserted, the court further found that "even the most limited investigation would have revealed that [Berg] had no standing to raise such a claim." The court also found that Berg's claim was motivated by a "desire to harass" and "delay litigation." The court fined Berg $10,000 and ordered him to attend six hours of ethics training.[5][6]

The injunction was denied by Justice David Souter on November 3, 2008. Berg also sought an application for injunction pending the disposition of the petition for writ of certiorari; Justice Souter denied it, Berg refiled and submitted it to Justice Anthony Kennedy (who denied it), then refiled and submitted it to Justice Antonin Scalia, who referred it to the Court. On January 12, 2009, the Supreme Court denied Berg's petition for writ of certiorari,[20] and on January 21 the Court denied the application for injunction.[21] The case is now alive and pending at the Third Circuit Court of Appeals for remedy.[citation needed

He has provided a copy of the only birth certificate available. The only reason there are still lawsuits is because they haven't exhausted all their legal options. When they all work their way up to the Supreme Court and then get dismissed because of lack of evidence will you guys stop harping on this? Why is it so hard to understand our basic legal process? He claims he's a natural born citizen and he has a recognized Hawaiian Birth certificate. To challenge that you either need to show that it wasn't valid or show his real birth certificate. The state of Hawaii backs the validity of the document and no one has offered a different B.C. There is no evidence, just whiners and whining carries no weight in court. Pony up with some tangible evidence and stop wasting the court's time.
